Terms of Service

These terms govern your use of blueorchid.world and the applications operated by Blue Orchid (“we”, “us”). By using the site or any of our applications, you agree to these terms. If you do not agree, do not use the services.

Who we are

Blue Orchid is a company that builds AI systems and publishes writing and tools at blueorchid.world. Contact: partner@blueorchid.world.

Use of the site and services

You agree to use the services only for lawful purposes. You will not:

• Break the law, infringe others' rights, or attempt to harm the services, our users, or third parties.
• Attempt to probe, scan, or reverse-engineer the services beyond what is permitted by law.
• Use automated tools to scrape the site or overwhelm our infrastructure.
• Upload content that is unlawful, infringing, harmful, or intended to deceive.
• Misrepresent your identity or access the services on behalf of someone who has not authorized you.

Accounts and connected services

Some of our applications require you to sign in or to authorize a connection to a third-party service (for example, Google, Slack, or Notion). You are responsible for keeping your credentials secure and for the activity that happens under your account or authorization.

Our access to third-party data is limited to the scopes you grant and is used only to deliver the features you requested, as described in our Privacy Policy. You can revoke access at any time from the connected service's security page.

Paid engagements

Consulting engagements, audits, and build work are governed by a separate written proposal or statement of work between you and Blue Orchid. Those documents control over these terms for the paid engagement, including scope, deliverables, payment, confidentiality, and intellectual property.

Content and intellectual property

Articles, tools, writing, designs, and software on the site are owned by Blue Orchid or licensed to us. You may read, quote, and share reasonable excerpts with attribution. You may not republish entire works, train commercial AI models on our content, or use our brand elements without permission.

If you submit content (inquiries, comments, testimonials, survey answers), you grant us a non-exclusive license to use it to operate and improve the services. Anything you mark as confidential is treated as confidential.

AI outputs

Our applications may generate text, images, or other content using AI models. AI outputs can be inaccurate or incomplete, and you are responsible for reviewing them before relying on them for a decision. Blue Orchid does not guarantee the accuracy of AI-generated content.

Third-party services

The site links to and integrates with third-party services (for example, Google, Slack, Calendly, Beehiiv, and AI providers). Those services are operated by their own providers under their own terms and privacy policies. We are not responsible for them.

Disclaimers

The services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure, or that any content is accurate.

Limitation of liability

To the maximum extent permitted by law, Blue Orchid will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising out of or related to your use of the services. Our total liability for any claim relating to the free site or applications is limited to one hundred US dollars (US$100). Paid engagements are limited to the amount you paid us for the engagement giving rise to the claim.

Indemnification

You agree to defend and indemnify Blue Orchid against claims arising from your misuse of the services, your violation of these terms, or your violation of any law or third-party right.

Termination

We may suspend or terminate access to the services at any time if you violate these terms, if required by law, or if continued service would create unacceptable risk. You can stop using the services at any time. Sections that should survive termination (ownership, disclaimers, liability, indemnity, governing law) will survive.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

Changes

We may update these terms. Material changes will be reflected by updating the effective date above and, if significant, posting a notice on the site. Continued use of the services after a change means you accept the updated terms.
